The New York Times on one of the worst kept secrets: that many successful gay marriages – and by extension, relationships – are open in modern way that straight marriages could never be.

Malawi Men Kept In Jail For Their Own Safety, Hawaii Legislators Failure, Utah Legislators Compromise, Boarder Boy Jesus, Ryan Phillippe And Kellan Lutz Separated At Birth

Thursday, the Malawi High Court again denied bail to 20 year old Tiwonge Chimbalanga and 26 year old Steven Monjeza citing concern for the couple’s safety. The two have been in jail since December 27th, arrested and charged with three counts of unnatural acts between men and gross public indecency. The trail is thought to resume February 5th.

Hawaii’s House Friday, prompted perhaps by election year fears, voted to postpone any action in 2010 on a civil-unions act that would have afforded same sex and opposite sex couples the same rights, privileges, and responsibilities as those allotted opposite sex marriage couples. The Senate last week, as previously posted, approved the measure with a two-thirds veto-proof majority, but the House opted for a voice vote that effectively ends any and all movement on the bill. Hawaii’s governor, Linda Lingle, seemed to suggest that the pro-gay proposal was not an urgent issue, saying “I understand there are real strong feelings on both sides, and so people would like to just get it settled, and get it resolved. I have felt from the beginning of this year that we needed to keep a clear focus on the economy. I’ glad we can just stay focused on that. There’s still the issue of our schools and the furlough issue out there, so we have some really serious things we need to work on together.”

In Utah Friday, an election year “compromise” by three Democrat legislators, approved by House and Senate leaders, to drop intentions for state-wide anti-discrimination ordinances, adoption and probate rights for gays, lesbians, bisexuals, and the transgendered until 2011 in order to protect and prevent an attack by Republicans on recently passed similar measures in Salt Lake City and Salt Lake County.

On Tuesday, American Defence Secretary Robert Gates and Admiral Mike Mullen, chairman of the Joint Chiefs of Staff, are expected to announce a special investigation into repealing the military ban on gays serving openly, but the process, from beginning to end, will likely take upwards of two years, as several practical issues – consequences from lifting the more than ten year policy – need consideration first.

Members of the Topeka, Kansas based Westboro Baptist Church, led by founder Fred Phelps’ daughter Margie, a disbarred attorney with an odd fixated hate for homosexuality, travelled to California Friday, to picket, protest, and promoted their lunatic brand of anti-gay and anti-Semantic hate, but their appearance at both the Palo Alto Gunn High School and nearby Stanford University was met with counter protests, and a promotion of love and tolerance. Oh, and the tires of their rented mini-van were slashed on two separate occasions, but that will happen when you hate.

Jarrett Barrios, the president of the Gay and Lesbian Alliance Against Defamation, wants CBS to explain how it is allowing an anti-abortion advertisement to air during the February 7th Super Bowl telecast, while refusing to allow an ad for a gay dating site. CBS has a problem when they do something like this at the same time as they an anti-gay group like Focus of the Family to place ads during the Super Bowl,” said Barrios, adding that “this network should come clean to the public about what’s going on because this seems to be a homophobic double standard.”

Spike TV meanwhile has no double standard, the basic cable network as gay as it wants to be, at least based on the evidence offered by its Blue Mountain State show, now not only offering jockstraps aplenty, but featuring college football teammates shaving each other’s nether regions. (NSFW)

CBS Rejects Gay Dating Site Commercial, ManCrunch.com Calls For Boycott, AT&T Discriminates Against Gay Couple, Gareth Thomas Hosts Coming Out Party, John Barrowman Joins Desperate Housewives, Brazil Male Models, Kerry Degman

Stating that the ManCrunch.com ad “is not with the Network’s broadcast standards for Super Bowl Sunday, CBS late Friday rejected the gay dating site commercial, according to reports, and reinforced the public perception that the network operates a double standard. The Toronto based company contends that the decision by CBS is “straight-up discrimination,” and the network still intends to air a thirty second anti-abortion spot for Focus on the Family featuring Tim Tebow and his mother.

ManCrunch.com, meanwhile, is asking gay advocacy groups to join a women’s coalition and protest CBS’s decision to air the Tim Tebow anti-abortion ad, arguing that it is not suitable to air during the Super Bowl.

Bryan Dickenson, a communication technician with AT&T for twelve years asked for time off to care for his partner of thirty years, Bill Sugg under the American Family Medical Leave Act to care for Sugg who suffered a debilitating stroke in September. AT&T denied the request, and Dickenson, instead of using the twelve weeks afforded all heterosexual couples under the Act, has been using his vacation time, but he worries that once that time expires, he will be fired. AT&T, constantly ranked as one of the most gay-friendly employers in the United States, contends it is following both state and federal law, which does not recognize the two men as domestic partners.

Testimony at the federal trial challenging the constitutional validity of the California gay marriage ban – Proposition 8 – ended Wednesday, and attorneys for the plaintiffs, as well as legal analysis believe that United States Chief Justice Vaughn Walker will likely rule in favour of the opponents of the amendment that defines marriage as that only existing between a man and woman. Walker could render his ruling as early as March. Whatever the decision, either side is apt to appeal, the case certain to reach the United States Supreme Court. By all accounts –save their side – proponents of Proposition 8 performed badly, with witnesses that appeared amateurish, and argument that lacked direction and was passive. The opposite was true of the opponents, with lead lawyers David Boies and Ted Olson masterful and in complete control.

American Pentagon Press Secretary Geoff Morrell Thursday said that the Defence Department will propose “a way forward” next week to lift the ban on gays serving openly in the military. Morrell added that the “secretary and the chairman have and will continue to work on an implementation plan, and we’ll be able to share (details) with you early next week.”

Following fast and furious in the footsteps of ABC and that network’s display of double standards evidenced by the reaction to Adam Lambert’s man on man kiss, CBS continues to make a mess of the Super Bowl telecast, and perhaps more importantly, continues to cultivate a massive distraction away from the game, with more reports on the network’s passive/aggressive rejection of a ManCrunch.com ad. The ad, available in the link, is actually funny, and harmless – its low-fidelity production contribute to the charm – but CBS insists that there are no spots available to purchase (an untruth) and that the commercial is still under review.

A coalition of the Gay and Lesbian Alliance Against Defamation and the Los Angeles Gay and Lesbian Center are urging Grammy organizers to take advantage of Sunday’s telecast – on CBS- to denounce music that “promotes or celebrates violence against any group of people.” Buju Banton was nominated this year for best reggae album, and although Banton, who has an unrepentant history of espousing violence against gays, sits in a federal jail in south Florida awaiting trial on cocaine trafficking charges and will not attend the presentation, the nomination itself has angered gay groups, who suggest that honouring him honours hate.

The Indiana Senate Thursday voted 38-10 in favour of a constitutional amendment to ban gay marriage. It is the fourth time the Senate has done so, the measure sent to the House, where it will again be defeated. Senator Carlin Yoder, a Republican, the author of the amendment said “marriage is one of the foundations of our society. It is something that I firmly believe needs to be protected.”

There are reports Thursday that ManCrunch.com – a gay dating site whose slogan is “where many, many, many men come out to play” – submitted an advertisement to CBS Monday, January 18th for review to air during the Super Bowl telecast February 7th. The ad reportedly features three men, on a couch, bowl of chips between them, watching a football game. When two of three reach for the chips at the same time, they begin making out “wildly.” When ManCrunch.com contacted CBS representatives Friday, January 22nd, they were told by the network that “the spot hadn’t been officially approved of yet” but added that “all the Super Bowl spots were sold out.” ManCrunch.com informed CBS to continue its review process in case a commercial dropped out, as historically happens. However, a network representative told Pop Tarts that commercial space was still available. ManCrunch.com – cleverly cultivating free publicity at the expense of CBS’s homophobia – contends that the network does not want to reject the ad outright, fearing that decision would highlight an obvious double standard that sanctions a Tim Tebow starring anti-abortion ad for Focus on the Family, while censoring a gay dating site commercial.

On Wednesday, federal prosecutors in Mexico indicted that they will attempt to repeal Mexico City’s gay marriage law as well as law that allows gays to adopt, arguing the laws violate the country’s constitution. The Mexico City ordinances were passed in December and are scheduled to take effect in March. However the federal Attorney General Office released a statement that the law “violates the principle of legality, because it strays from the constitutional principle of protecting the family.”

President Obama Still Wishing And Hoping Someone Does Something To Repeal DADT Just Not Him, Study Reveals DADT Disgusting Costs, Fred Phelps And The Westboro Baptist Church Tour San Francisco, Jason Chaffetz Introduces Anti-Gay Marriage Bill Ignoring Reality, River Viiperi Is A Hot Hero, Daren Kagasoff Prefers Briefs

President Obama, in Wednesday’s State of the Union Address, said “This year I will work with Congress and our military to finally repeal the law that denies gay Americans the right to serve the country they because of who they are.” So semantically, he is not calling for a repeal of the military ban on gays serving openly, but rather calling for Congress and military officials to repeal the ban, both of which can count on Obama’s cooperation.

A new study conducted by the Williams Institute at the University of California at Los Angeles concludes the military ban on gays serving openly in the military costs hundreds of millions of dollars and that a repeal of the ban would save funds, and also attract more skilled military personal. The study found that there is an estimated 66,000 gay, lesbian, and bisexuals currently serving in all branches of the military, but all of those are required by law to keep their sexual orientation secret. The study calculated that the policy of “don’t ask, don’t tell” has cost the military upwards of 290 million dollars since its inception.

Fred Phelps and his merry band of hate-mongering Westboro Baptist Church congregation are in San Francisco, California Thursday, there to tour and protest. The anti-gay, Anti-Lady Gaga, anti-hockey, and anti-Semantic zealots have a busy itinerary, including scheduled stops at the offices of the Anti-Defamation League, the Jewish Community Center, and Twitter.

Representative Jason Chaffetz, Republican, from Utah, who is tenacious in anti-gay marriage fervour, introduced a bill Wednesday to overturn a District of Columbia ordinance legalizing gay marriage. It is unlikely that the bill will come to a vote, since the Democrats control the House, but Chaffetz said “I wish it would come up for a vote, because I think traditional marriage would win.”

United States General John Shalikasvili, who, as the Chairman of the Joint Chiefs of Staff in 1993, implemented the military ban on gays serving openly, has issued a statement calling for its immediate repeal. “As a nation built on the principle of equality, we should recognize and welcome change that will build a stronger more cohesive military. It is time to repeal “don’t ask, don’t tell” and allow our military leaders to create policy that holds our service members to a single standard of conduct and discipline.” His heed comes just ahead of the president’s State of the Union Address Wednesday evening.

Gayle Haggard, the wife of disgraced former evangelical pastor Ted, whose involvement with methamphetamine and male prostitutes is well documented, Wednesday on the Today Show promoting her new book, Why I Stayed: The Choices I Made In My Darkest Hour that thanks to therapy Ted no longer is a prisoner to gay compulsive urges. Ted himself told Oprah that thanks to intensive therapy, focussing on an incident in his childhood, he has “not had one thought or compulsive behaviour.”

Students, faculty, and community members Wednesday demonstrated at the University of Notre Dame in favour of amending the campus code of anti-discrimination policy to include sexual orientation. Notre Dame, a private Catholic university, does not formally recognize gay students and has no support groups in place geared towards gays. The protestors delivered a letter to the president, Reverend John Jenkins, requesting that the university acknowledge a gay campus group as well as update its policies.

ABC – which was once a bastion of creative, gay entertainment – has announced it is cancelling Ugly Betty. This season, the show’s fourth, will be it last, and rather than 22 episodes, will be shortened to 20. This as the show finds itself amid an artistic resurgence.

Third Florida Gay Adoption Approved Despite State Ban, Justin Waller Charged, Gay Hating Fireman Promoted, Anderson Cooper To Move Into Historic West Village Firehouse, Lance Bass Power Bottom, David Beckham A Ten, Dan Felton An Eleven

As a Miami, Florida appeals court determines the constitutional validity of the state’s gay adoption ban, Miami-Dade Circuit Judge Maria Sampedro-Iglesia early in January approved the adoption of a one year boy to Vanessa Alenier. The boy, who had been taken into custody by child welfare workers when he was born, is a relative of Alenier, who is gay and who lives with long time partner Melanie Leon. In her ruling, the judge wrote that “there is no rational connection between sexual orientation and what is or is not in the best interest of a child. The child is happy and thriving with [Alenier]. The only way to give this child permanency ... is to allow him to be adopted.”

Justin Waller, 31 years old, was formally charged Tuesday evening with second-degree murder in the horrific killing of his former live-in lover 41 year old John Lea. Lea’s body was discovered by New York City Police last Thursday, and Waller was arrested Friday in Vermont. Waller was held without bail and will make another appearance in a Manhattan court Friday.

The three firefighters in Secaucus, New Jersey who stand accused in a civil lawsuit of harassing two former gay residents were not reinstated to their positions with the volunteer fire department. However one of the men was promoted as the superintendent of the Department of Public Work. Secaucus lost the civil suit filed by the gay couple who said they were systematically harassed by the three while living near a firehouse. The three resigned from the department instead of facing an administrative hearing.

Anderson Cooper – not gay, but gay – and his boyfriend, bar owner Benjamin Maisani, will soon be moving into a historic West Village century old firehouse, bought for 4.3 million dollars in September. The three story Beaux Arts style building ceased formal operations in 2006, thanks to massive spending cuts by Mayor Bloomberg, and is it being busily renovated and brought up to code.

eHarmony Proposes Gay Discrimination Settlement, CBS Says Focus On The Family Ad Part Of Eased Restrictions, Clay Aiken And Reed Kelly Get Hot, Ellen DeGeneres And Simon Cowell Fight, Adam Lambert Wrapped, Adam Coussins Stripped, Simon Nessman

eHarmony has agreed to settle a lawsuit filed in California that claimed the online dating site discriminated against homosexuals. The settlement, filed in a Los Angeles Superior Court on Tuesday, proposes that eHarmony will link to its gay and straight Web site, and allows individuals to use both without being double billed. The company also agreed to pay an estimated 500,000 to 150 Californians who were a part of the class-action lawsuit, in addition to attorney’s fees and court case. Under the proposal, eHarmony admits no wrong doing. A judge must now approve the settlement, a court date scheduled for February 3rd.

CBS announced that the network has eased restrictions on advocacy advertisements and that it would consider “responsibly produced” ones for broadcast on February 7th during the Super Bowl. There are reports that the delay in announcing congressional hearings on the ban on gays serving openly in the American military is at the request of the Obama administration because the president may during the State of the Union Address scheduled for Wednesday evening himself announce that military leaders have indicated they are willing to support repealing the ban. The Senate Armed Services Committee is to have another in a series of hearings, and committee chair Senator Carl Levin, a Democrat of Michigan, said senior Defence Department officials make the request to delay any announcements until after the presidential address. In the Wall Street Journal Monday, Richard Socarides, the former Clinton White House advisor on gay issues, wrote of the growing impatience with the Obama administration to take any action at all on repealing the military ban, Socarides saying “Mr. Obama’s oversensitivity to a dwindling minority of bigots” is “especially troubling.”

A coalition of American women’s groups is urging CBS to reject an advertisement scheduled to air during the Super Bowl February 7th, the commercial sponsored by the anti-abortion, anti-gay group Focus on the Family to star Tim Tebow and his mother, Pam. CBS approved the script Friday, but has yet to view the finished film. Jehmu Greene, the president of the Women’s Media Center, said “an ad that uses sports to divide rather than to unite has no place in the biggest national sports event of the year – an event designed to bring Americans together.” The group wrote a letter to CBS that reads in part “By offering one of the most coveted advertising spots of the year to an anti-equality, anti-choice, homophobic organization, CBS is aligning itself with a political stance that will damage its reputation, alienate viewers, and discourage consumers from supporting its shows and advertisers.” Others insist that the day itself is solely for football, and to include a conversation about abortion is a calculated mistake by both the network and Focus on the Family.

Meet Eugene A. Delgaudio, a Republican, and a Loudoun County Virginia Supervisor, an ignorant individual so spectacularly stupid it does defy logic. The board too, called for him to issue an apology, James Burton, an Independent, said Delgaudio had “conducted himself in a manner best described in my opinion as histrionic, and his choice of words were and should have been an embarrassment to this board and to the county.” Burton added that the use of the word ‘it’ was ‘demeaning, insulting and dehumanizing.” Delgaudio issued a statement, as insulting and offensive as his initial remarks, saying “with apologies to the real-life Tootsies” and “to all their defenders who are calling me all sorts of names and, like Mr. Burton, are saying I should apologize.” He then turned to James Burton and said, “Lady doth protest too much.”

A rumoured protest in Park City, Utah, outside of the Sundance screening of 8: The Mormon Proposition failed to materialize Sunday. On Friday, America Forever, a Utah based anti-gay group, issued thousands of faxes denouncing the film and the festival, but they too were no shows. The film examines the unprecedented influence and involvement of the Church of Jesus Christ of Latter-day Saints in passing Proposition 8, the California voter amendment that repealed a gay marriage law.

A Reuters video report on the Uganda Anti-Homosexuality Bill of 2009, the horrific legislation to have a second reading before Parliament in February, that proposes increased punishments for suspected gay men and women and for those who fail to report suspected gays and lesbians.

21 year old Susan Grover has been arrested and charged with second-degree assault in connection to an attack on 29 year old Lindsay Harmon that took place early New Year’s Day in Buffalo, New York. She is currently being held in custody. Frank Sedita, the Erie Country District Attorney said he intends to seek an indictment under the New York State Hate Crime Statute. Harmon, who is still recovering from having her eye slashed, said she and her partner cried upon hearing that an arrest had been made.

Actor James Mitchell, who starred in the film version of Oklahoma as well as Band Wagon, has died. He was 89. In Wyoming, Platte County School District 1 trustees voted 4-3 remove Anti-Defamation League “No Place for Hate” banners from both Wheatland High School and West Elementary because one of three sponsors of the banners is the Gay and Lesbian Fund for Colorado. The other two are Qwest and the David and Laura Merage Foundation. The anti-hate campaign is running in a total of twenty-five schools in both Colorado and Wyoming. Testimony at the federal trial challenging the constitutional validity of the California gay marriage ban – Proposition 8 – continued Thursday in a San Francisco courtroom, attorneys for the defence cross-examining Stanford University political science Professor Gary Segura, suggesting that several churches in fact opposed the same sex marriage ban. Plaintiffs announced that they will be calling William Tam as a hostile witness, Tam having requesting to be released as a witness for the defence.
