Court Of Appeal Again Rules Florida Anti-Gay Adoption Ban Unconstitutional
The Associated Press is reporting that the 3rd District Court of Appeal in Miami has upheld a ruling overturning a Florida law banning adoption by gay men and women, the 3-0 ruling affirming a lower court decision that found the ban unconstitutional. Florida, for now, is the state in America that expressly prohibits gays and lesbians from adoption without exception. Gays and lesbians can however act as foster parents. Martin Gill and his partner, along with the American Civil Liberties Union, filed the lawsuit in their attempt to formally adopt two brothers, who have been their foster children since December, 2004. In 2008, a Miami-Dade County judge ruled the Florida gay adoption unconstitutional, but the state soon appealed. The case will certainly be heard by the state Supreme Court. This case was the one in which now disgraced ex-gay George Alan Rekers was paid $120,000 to appear an expert witness for the state by Attorney General Bill McCollum.
