Six same sex couples in Hawaii are filing a lawsuit Thursday in Circuit Court, requesting that the court order that gay couple be permitted to enter a legal status – civil union – that would have afford them the same rights, benefits, and responsibilities that opposite sex couples can acquire through marriage, in other words asking that court do what the Hawaii Legislature could not or would not do: reverse Republican Governor Linda Lingle’s cowardly decision to veto House Bill 444. Among those participating plaintiffs is Linda Hamilton Krieger, along with partner Kathleen Sands. Krieger says that the rationale employed by the outgoing governor in exercising the veto - that the decision of civil unions or gay marriage is “of such societal significance that the people of Hawaii deserve the right to directly decide whether the changes contemplated by House Bill No. 444 should become law” – is in fact flawed logic. “In this country,” said Krieger, “we don’t put people’s fundamental rights up to a popular vote. If we did that, our school would probably still be segregated.”
However, according to Garret Hashimoto, the chairman of the Hawaii Christian Coalition, most state residents do not want the government to endorse equal rights for same sex couple, saying “I feel insulted. They keep bringing up Martin Luther King, black rights and women’s suffrage. This is not about that. This is about two males or two females practicing sex. It’s behaviour. It’s not different from smokers or drinkers.”
