Attorneys For Accused Killer Of Lawrence King File Motion To Recuse Judge, Parsing Supreme Court Ruling For Hints On Gay Marriage, Boy Singers Blind Item, Dean Sheremet, Neil Patrick Harris Does Guys With iPhones, Joe Jonas And Kellan Lutz Do Something

Attorneys for Brandon McInerney filed a motion Monday requesting that Ventura County Superior Court Judge Charles Campbell be recused from the case, the motion arriving after the judge refused to allow McInerney’s lawyers additional time to prepare for trial. 15 year old McInerney is charged with first-degree murder in the shooting death of 15 year old Lawrence King, shot twice in the head by his fellow classmate. There is a special allegation of lying in wait, as well as a hate crime stipulation, Lawrence being gay. The prosecutor, Maeve Fox, said in court that the filing of the motion was a legal “ploy” and added that “it’s really a travesty upon the court system and the rule of law ...this is ridiculous and disgraceful.” Scott Wippert, the attorney for McInerney, said outside the courtroom that “it is clear in our minds that Brandon will not be able to get a fair trial in this courtroom. It is perfectly without our legal obligations, and ethical obligation to do so on Brandon’s behalf,” although he declined to specify what precipitated the motion. Brandon McInerney, being tried as an adult, appeared in court Monday, dressed in a black tie, white shirt, and black pants.

Will a seemingly innocuous statement by the United States Supreme Court, written by Justice Ruth Bader Ginsberg in the recent ruling that found a Christian student law group could not discriminate based upon sexual orientation, that spoke of gay men and women as having attained a “status” an important barometer in predicting court rulings in favour of extending full equality to gays and lesbians?
