Syncrude Found Guilty In Landmark Dead Ducks Environmental Case, Pride Toronto Battle Looms, Judge Rules Anti-Gay Man Can Attend Minneapolis/St. Paul Pride, GLAAD Calls Out The View Stupidity, Inside James Franco Solo Art Show, Inside New A&F Quarterly, Backstage With Evandro Soldati And Arthur Sales And Marlon Teixeira

Syncrude Canada Limited, an oil and gas giant, was found guilty Friday on both charges in an Alberta provincial court – a provincial count of failing to prevent a hazardous substance from coming into contact with wildlife and a federal count of depositing a substance harmful to migratory birds. The charges were the result of the discovery on April 28th, 2008 of more than 1,600 ducks in a tailings pond – a 12 square-kilometre toxic lake that is used in the industrial processing of the bitumen mined from the Alberta oil sands. Judge Ken Tjosvold said that “Syncrude had in previous years cut back substantially on a number of deterrents. Staff had been reduced. It should have been obvious to Syncrude that deterrents should be in place as early in the spring as possible. Syncrude did not deploy the deterrents early enough or quickly enough.” Attorneys for the oil company have argued that the two charges are too similar and amounted to double jeopardy. Judge Tjosvold said that the Crown and Syncrude could argue which of the two charges is most serious, allowing that only one of the charges might be formally entered as a conviction. The victory is an obvious one for environmentalists, who point to the possibility that tailings pond – which are paramount to the refining of oil sands bitumen – illegal.

Federal Judge John Tunheim ruled Friday that Twin Cities Pride cannot prohibit a Wisconsin man, Brian Johnson, from distributing the Bible and expressing his opinions against homosexuality at an event this weekend in Minneapolis. Twin Cities Pride had contended that since they were leasing out Loring Park for the weekend, they held the right to prevent Johnson from passing out literature. Tunheim, however, said that as long as Johnson remains undisruptive, his is entitled to exercise his right to free speech in a public park. Johnson appeared at the 2009 Gay Pride event, and was arrested. Organizers wanted additional restrictions put in place and requested a temporary restraining order be issued; a request the judge denied.

GLAAD has issued a call to action regarding the June 22nd episode of The View and a discussion about the Food and Drug Administration’s ban on gay and bisexual men donating blood. Co-host D.L. Hughley and host Sherri Shepherd – both spectacularly stupid – managed to equate the rise of newly reported HIV infections among African-American women to bisexual African-American men who sleep “on the down low.”
