Three gay couples, plaintiffs in a suit seeking to overturn Minnesota’s gay marriage ban, named the state as a defendant Tuesday. The decision was made after an attorney for Hennepin County, where the suit was filed, naming as a defendant the official who issues marriage licenses, argued that the suit should be dismissed for not naming Minnesota as a defendant. Mike Freeman argued earlier Tuesday that since the suit seeks to overturn some 500 state laws and regulations that have the effect of denying gay couples numerous rights that are by law extended to married opposite sex couples, the state must be the main defendant.
