Mary L. Bonauto, an attorney for the Gay & Lesbian Advocates & Defenders urged United States District Judge Joseph L. Tauro to strike down the Defense of Marriage Act, a 1996 federal law that defines marriage as that only existing between a man and a woman, contending that it is an unconstitutional intrusion on a matter previously left to states. Bonauto represents seventeen gay men and women who wed in Massachusetts - where gay marriage is legal - but who are barred from benefits that opposite sex obtain, including health insurance from federal employers, the ability to file joint federal income tax returns, and retirement and survivor benefits under the Social Security Act. “All the federal government has ever cared about is that the person is married at the state level,” said Bonauto, “for the first time ever, DOMA departed from that.”
