Arkansas Judge Overturns Anti-Gay State Adoption Ban, Taylor Lautner Attends All Gay Party, Marc Jacobs Continues To Conquer And Corrupt West Village, Prague, Ana Ortiz Hints Ugly Betty To Be Feature Film, Zac Efron Grows A Sexy Silly Moustache

Circuit Judge Chris Piazza Friday, in Little Rock, Arkansas, overturned a state law that prohibits unmarried couples – including same sex couples – from either adopting or fostering children. Act 1, approved by voters in 2008 by a 57-percent to 43-percent margin, and was challenged in court by the American Civil Liberties Union acting on behalf of a number of families. Piazza ruled that the voter initiative unconstitutionally burdens non-marital relationships and acts of sexual intimacy between adults by forcing them to choose between becoming a parent and having any meaningful type of intimate relationship outside of marriage, adding that “it infringes upon the fundamental right to privacy guaranteed to all citizens of Arkansas.” The state argued that the Act protects children, because, according to the state, children are better when raised in traditional family settings, with married parents, protecting them from abuse and neglect. Arkansas Attorney General Dustin McDaniel said that he did not personally support the ballot initiated, but that his office advised and defended the Department of Human Services throughout the trial, and in a written statement, said that the state had yet to decide whether to appeal. “A number of factors will have to be considered and evaluated before a decision is made as to whether an appeal would be in the best interests of the state,” read the release.
