David Boise, who, along with Ted Olsen, is suing the state of California in an effort to overturn Proposition 8, arguing that the voter amendment passed last November 4th by a 52 % majority is invalid because limiting marriage to those of the opposite sex is unconstitutional. Today, Boise has written an op-ed piece for the Wall Street Journal, arguing, among other points, that sexual orientation is not a behavior that can be regulated by the state, but a natural characteristic, that the passage of Proposition 8 was the “residue of centuries of figurative and literal gay-bashing,” and that due process and equal protection take precedent over the expression of religious freedom.
Arguing that there “no threat of consequences” the Supreme Court of India refused to accept a stay in the recent ruling by a New Delhi high court that overturning that capital city’s criminalization of homosexuality. In announcing the refusal, the Supreme Court stated that it would wait for the government of India to present its case in a hearing that has now been set for September 14th.
